INSTRUCTIONS: This Attestation of Income-Based Eligibility is to be completed and signed by a member of the applying household. (The Subscriber Organization may assist in completing the form.) It is a written statement confirming that an applicant’s provided information and  documentation is complete and accurate, and that this qualifies the household to be an income-eligible subscriber.

TENNESSEN WARNING: NOTICE OF COLLECTION OF PRIVATE DATA
The Minnesota Department of Commerce operates a community solar garden program authorized under Minnesota Statute Section 216B.1641. The Department is requesting that you supply data about yourself classified as private under the Minnesota Government Data Practices Act. This form will be collected and retained by your Subscriber Organization or their representative and will only be shared with the Minnesota Department of Commerce or its designee.

The Department requires that this form be completed if you are seeking to become an income-qualified subscriber to a community solar garden overseen by the Department. To be income-qualified, you must demonstrate that your household’s total annual income is at or below 150% of the area median income, which varies by county and household size.

Should you choose to not provide the information requested on this form, you will not be able to qualify as an income-eligible subscriber. Other subscription opportunities may be available; please consult with the Subscriber Organization.

The purpose of this form is to provide Community Solar Garden Subscribers with a straightforward, uniform, and transparent resource to evaluate potential  transactions under Minnesota’s Low and Moderate-Income Accessible Community Solar Garden program. This document is not your contract. Read this document and your contract carefully so that you fully understand your contract.

Community Solar Subscribers do not directly purchase solar electricity. Instead, participants purchase a subscription in exchange for solar garden bill credits that will be applied to their utility bill. The cost of a Subscriber's community solar garden subscription must not exceed the value of the Subscriber's community solar garden bill credit. For income-eligible households, the cost of the community solar garden subscription must not exceed 90 percent of the Subscriber's community solar garden bill credit and must not include any fees at the time the subscription is executed.

Bill Credit Rate: The Bill Credit Rate is the rate you will receive on your Xcel Energy utility bill for each kilowatt hour of electricity the community solar garden generates on your behalf. Typically, the bill credit rate changes every year.

SunShare Community Solar Rate: This is the rate you will pay to SunShare for each kilowatt hour of electricity the community solar garden generates on your behalf. It will be 20% lower than the Bill Credit Rate you receive on your Xcel Energy utility bill for each kilowatt hour of electricity the community solar garden generates on your behalf.

Typically, the Bill Credit rate changes every year, and your community solar rate will be adjusted accordingly. Regardless of the Bill Credit rate, your SunShare bill will be 20% less than the Bill Credits you receive for the given production month!

Payment Details You have a choice in how you would like to be billed for your community solar subscription costs:
☐ Consolidated Billing (one bill): If you would like to receive only one bill, please elect consolidated billing. With Consolidated Billing, you will see both your community solar credits and charges on your existing Xcel Energy bill. With this option, you will also be able to apply any energy assistance or LiHEAP funds that you may be currently receiving on your Xcel Energy account to your subscription costs.

☐ SunShare Billing (two bills): If you decline consolidated billing, you will receive two bills each month; one from Xcel Energy that shows your community solar credits, and a second invoice from SunShare for your community solar charges.

Monthly Payments. The amount you owe us (“Monthly Subscriber Payment”) is equal to the kWh of Solar Energy produced and delivered from the Solar Garden to Xcel Energy during a production month, multiplied by the price per kWh in effect during the month in which the production occurs. Your Monthly Subscriber Payment Schedule will be calculated based on the applicable Bill Credit rate in effect at the time of each monthly bill.

You will only be charged a Monthly Subscriber Payment for Bill Credits you receive.

Penalties You can cancel with 90 days’ prior written notice with no penalty.

Late Payments; Disputed Invoices. If you pay us late (after the Due Date listed on your invoice), we have the right to charge you interest on the unpaid balance at the rate of two percent (2%) per month, or at any lesser maximum rate permitted by law, until you have fully paid your past due balance. If you dispute all or a portion of an invoice from us, or if any other claim or adjustment arises under this Agreement, you agree to pay the undisputed portion when due and provide us with notice of the amount in dispute.

Contract Term ✓ The length of your SunShare agreement is simply the length of the agreement between SunShare and Xcel Energy to deliver solar energy onto the power grid. This is also the length of time for which you are guaranteed to receive Bill Credits from Xcel Energy on your utility bill.

Transferring or moving a subscription You may transfer your subscription to your own or another person’s new Location, within Xcel Energy's Minnesota territory, provided the proposed Location meets our eligibility requirements and such other person consents to this transfer, as determined at our sole discretion. Data Sharing and Privacy Policy Information Disclosures. You agree that we are authorized to provide specific and limited information related to your subscription or your participation in the Solar Garden(s) that may be required by Xcel Energy, the PUC, the Minnesota Department of Commerce, or the Minnesota Office of Attorney General. You agree to complete and execute any forms necessary to effect said authorization. Terms of Service, Section 7

Additional Information
A Renewable Energy Certificate (REC) represents the environmental attributes associated with one (1) megawatthour of renewable energy. RECs generated by a community solar facility are transferred to the qualified utility and are not the property of the Subscriber or the Subscriber Organization. While the Subscriber is not able to claim the purchase of renewable energy, participation in the community solar program does support additional development of renewable energy in Minnesota.

The value of the Solar Bill Credit for each Subscriber type is established by the Minnesota Legislature. The value is based on a percentage of the average retail rate of electricity for each individual Subscriber type and thus will be automatically adjusted with any changes in retail rates.


In case of Subscriber complaints
The Minnesota Department of Commerce urges subscribers to contact their Subscriber Organization’s customer representative (named above) with any concerns or complaints about billing or terms of their agreements. If the complaint cannot be resolved, the subscriber should contact the Minnesota Department of Commerce Energy Division at 651-539-1886 or send an email to CommunitySolar@state.mn.us.

After investigation of the complaint, the Department may refer unresolved issues to the Minnesota Office of the Attorney General for further action.


Consolidated Billing
As a subscriber, you may elect to pay your community solar subscription costs as part of your electric utility bill, rather than to pay your  subscription costs as part of a separate bill from your Subscriber Organization.

This combining of two bills into one is known as "consolidated billing." Participating in consolidated billing will not impact your solar bill credits, your  subscription costs, or your net savings from the program. It is a free service offered for your convenience.
